Searched every social media platform and forum there are only questions with no solutions, however, for those like me searching everywhere, I have found a workaround until Sony fixes what seems to be a bug.
Even when chat audio is set to output out of the HDMI device it still does not work if the controller is the only input device. In order to force chat audio out of the TV speakers you need to give the PS5 a second input option, and then make sure HDMI is the output device. It will work after that.
For QOL make sure to turn off audio output auto switching.
